Therefore in order to achieve ongoing positive action as an organisation we have had to endeavour to do find a way to establish a human rights respecting culture more deeply within the customs and practices of the organisation. This we are addressing by including human rights explicitly within our Quality Framework. We now ask ourselves the question: Do we uphold the statutory rights of people (Human Rights, Equalities, Citizenship, MCA, MHA, etc. )? To achieve this standard we are placing human rights alongside safeguarding in our mandatory training for all staff. We have also created an incident reporting category for Human Rights Concerns so that staff can report any such concerns simultaneously to their colleagues and managers so that these can be investigated and responded to appropriately. Taking positive action
As well as having improved our assessment and support planning procedures so that they are more solid in respecting human rights we are now also exercising our positive duty to protect human rights more effectively.

If you have a family member or friend who is in hospital, you can be involved in the person's treatment, with their permission. Most hospitals will have workers whose main job is to help families learn about the person's illness, find community supports and work out how to best use the health-care system.

However, in all but the rarest exceptions, the opposite is true. People with mental illness represent a largely untapped and vast source of labour, knowledge, and ideas. They are largely under-represented in the Canadian workforce. "Their potential productive energy has been overlooked at an enormous cost to the individual as well as at a significant social and economic cost to the community. " The cost to the individual is akin to the cost that a person without mental illness would suffer if they couldn't find work; a person who chronically struggles to find work/financial sustenance undergoes a great deal of stress and lowered self-esteem. Individuals who have mental illness are no different in this respect. What is Mental Illness? The Canadian Mental Health Association (CMHA) defines mental illness as when the brain does not work in the way that it is supposed to.

You can choose to manage your own accommodation without support, get support to live in your own home, live in supported accommodation, live in shared accommodation or live with family / friends. You may also choose to buy a place on your own or with family/friends, or to rent from a private landlord, your local Council, a Housing Association or other Registered Social Landlord, or a housing charity. If you are in hospital long-term then an outcome may be to stay in a suitable ward with the maximum amount of comfort, safety and independence. Another goal may be to maintain, repair or improve your home ensuring that your accommodation is warm, weatherproof, equipped with modern facilities, in a good state of repair, safe and secure. Are you close enough to family, friends, green spaces or the services you use? You may also want to ensure that your accommodation meets your physical requirements (e. g. if you have poor mobility or eyesight). Finally, your outcome may be to deal with financial issues such as managing mortgage payments or rent.
We are now seeing a range of human rights issues being flagged up that may otherwise have gone by and been unattended to. Recent examples include:
staff raised a concern over the positioning of a CCTV camera where people are likely to cross a communal area to and from a shower room in a state of undress believing that they are not being observed
staff raised concerns when an agency care worker entered a resident's room without knocking first when this was neither permitted nor agreed under the individuals support plan
we have confidently resisted requests from a group of neighbours for our staff to wear high visibility (fluorescent) jackets when supervising our residents in the neighbourhood. In broader terms we have also used a human rights approach to respond more swiftly and in partnership with the police and safeguarding teams, when it is clear that residents are unsafe in their placement due to the violence or harassment by another. We have consequently seen a marked reduction in the level of serious incidents within our projects (housing units).
Restraint is where a person is physically restricted from moving around, for example by someone holding them, through medication, or by being strapped down. Seclusion and restraint are a last resort where all other options to keep people safe have been tried or considered. Both should be very rare. Your rights in hospital
Tell hospital staff if you are uncomfortable with any part of your treatment or are unsure of anything. While in hospital, you have the right to:
privacy
safety
respect for your cultural identity
ask questions about your treatments and medications and their side effects
know your diagnosis, and disagree with it
get a second opinion (this could be at your own cost)
refuse treatment (though if you are under an involuntary order your doctors may end up insisting on some medications)
make a complaint
have a family/whānau member, friend, family consultant or anyone you choose to help you ask questions.
3. Who can support you to achieve your goals? Your local Council has a legal duty to advise you on housing if you are unable to find your own accommodation and a duty to get you housing if you are vulnerable. Other people who can support you include:
